By accessing or using the website located at arcadiaconcretecompany.com (the "Site"), by contacting Arcadia Concrete, or by engaging us to perform any services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Site or engage our services. These terms apply to all visitors, inquiries, and customers.
Arcadia Concrete provides concrete contracting services including, but not limited to, driveway installation, patio construction, foundation work, retaining walls, stamped and decorative concrete, concrete cutting, and related flatwork. All services are provided in the greater Arcadia, CA area and surrounding communities. We reserve the right to decline any project at our discretion.
All estimates provided by Arcadia Concrete are based on conditions observed at the time of the site visit, information provided by the customer, and prevailing material and labor costs. Estimates are valid for 30 days from the date of issue unless otherwise stated in writing.
An estimate is not a binding contract until both parties have signed a written agreement. Verbal estimates are not binding. The final project price may change if the scope of work changes at the customer's request, if site conditions differ materially from what was observed during the estimate, or if unforeseen conditions are encountered after work begins (such as buried obstacles, unstable soil, or existing damage not visible before demolition).
Any change to the original scope of work must be agreed upon in writing by both parties before additional work proceeds.
Project start dates are scheduled after a signed agreement and, where required, after permits are approved by the applicable city or county authority. Start dates are estimates and may shift due to weather conditions, permit processing delays, material availability, or other factors outside our control. We will communicate any changes promptly.
Concrete work may be delayed or rescheduled if weather conditions at the time of the planned pour present a risk to the quality of the finished product (for example, rain within 24 hours of the scheduled pour). Such rescheduling is standard practice and does not constitute a breach of our agreement.
If you need to cancel or reschedule a confirmed project, please notify us as soon as possible. Cancellations made after materials have been ordered or work has begun may result in charges for costs already incurred. The specific cancellation terms for your project will be outlined in your written agreement.
Payment terms are set forth in the written project agreement. A deposit may be required before work begins. The remaining balance is typically due upon project completion unless a different schedule is agreed upon in writing.
Accepted payment methods will be specified in your project agreement. Invoices not paid within the timeframe stated in the agreement may be subject to a late fee as specified therein. Arcadia Concrete reserves the right to suspend work on any project where payment is overdue.
Under California law, contractors may file a mechanic's lien against a property when payment for labor or materials is not received. We prefer to resolve any disputes directly and promptly, but we reserve the right to pursue all remedies available under applicable law.
You are responsible for ensuring that the work area is accessible and clear before the scheduled start date. This includes removing vehicles, personal property, and obstructions from the project area. You are also responsible for notifying us of any known underground utilities, buried pipes, irrigation lines, or other subsurface features in or near the work area.
If your property is subject to homeowners association rules or local permit requirements, it is your responsibility to obtain any required HOA approvals before work begins. We will obtain required building permits on your behalf as part of our service, unless otherwise agreed in writing.
Arcadia Concrete warrants that all work will be performed in a workmanlike manner consistent with applicable industry standards. Any warranty terms specific to your project will be described in your written agreement.
Concrete is a natural material subject to normal variation in color, texture, and minor surface cracking as it cures and ages. Hairline cracks that develop during the curing process are normal and are not a defect. Warranty coverage does not extend to damage caused by misuse, vehicle traffic before the recommended curing period has elapsed, tree root intrusion after installation, acts of nature, or modifications made by anyone other than Arcadia Concrete.
Except as expressly stated in a written warranty provided with your project, all services are provided "as is" without additional warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.
To the maximum extent permitted by applicable law, Arcadia Concrete and its owners, employees, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the services provided, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim related to a specific project shall not exceed the total amount you paid for that project. This limitation applies regardless of the theory of liability, whether in contract, tort, or otherwise.
We encourage you to contact us directly if you have any concerns about our work or any aspect of your project. Most issues can be resolved quickly with a direct conversation.
If a dispute cannot be resolved informally, the parties agree to attempt mediation before initiating any formal legal proceeding. Mediation shall be conducted by a mutually agreed-upon mediator in Arcadia, CA. If mediation does not resolve the dispute, either party may pursue their legal remedies in the courts of CA.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of CA, without regard to its conflict-of-law provisions. Any legal action or proceeding arising out of or relating to these terms or our services shall be brought exclusively in the courts located in CA.
The content on the Site, including text, images, and other materials, is provided for general informational purposes only. We make reasonable efforts to keep information accurate and up to date, but we make no warranties about the completeness, accuracy, or reliability of any content on the Site. We reserve the right to modify or remove content at any time without notice.
